Affiliate King Merchant Terms
Effective date: 7 October 2026. Last updated: 19 October 2026
These terms are an agreement between Dubient Designs Pte. Ltd., a company registered in Singapore ("we", "us"), and the business that installs Affiliate King on its Shopify store ("you"). By installing or using Affiliate King, you agree to these terms, including the Data Processing Agreement in Part B. If you install it on behalf of a business, you confirm you can bind that business.
Part A: Terms of service
1. What Affiliate King does
Affiliate King helps you run a creator or affiliate programme. Creators apply through a sign-up page, get referral links and discount codes, and earn commission on the sales they refer. You approve creators, set the commission rules, and record payouts.
Affiliate King works out the commission owed. It does not send money. You pay creators yourself, by your chosen method, and you record each payout in the app.
2. Your account and Shopify
- You need a Shopify store to use Affiliate King. Your use of Shopify is governed by Shopify's own terms.
- You are responsible for everyone who uses the app through your store's admin, and for keeping that access secure.
3. Plans and billing
- Plans: Affiliate King has a Free plan and a paid Premium plan. The App Store listing and the app describe what each plan includes.
- Billing: Shopify bills Premium charges on our behalf, through your Shopify invoice. Shopify's billing terms apply, including those on refunds.
- Free trial: Premium may come with a free trial. If you don't cancel before the trial ends, Shopify starts charging.
- No fees on sales: we don't charge a percentage of your sales.
- Price changes: we may change prices. Shopify shows you any new price, and you must approve it before you're charged.
- Downgrading: if you move from Premium to Free, Premium features stop applying from that moment. For example, new orders earn your base commission rate. Your saved settings and past records stay as they are.
4. Your responsibilities
You are responsible for your creator programme. In particular, you must:
- Pay creators what they earn under your programme rules, and set those rules clearly.
- Follow the law:
- advertising and disclosure rules, such as requiring creators to disclose that they're paid
- consumer protection laws
- tax, payment and employment laws
- privacy and anti-spam laws
- Have a lawful basis for the data you collect, including:
- the questions you add to your sign-up form
- a cookie banner that collects shoppers' consent wherever the law requires it
- Keep your store's privacy policy up to date. It should mention your creator programme and Affiliate King.
- Not use Affiliate King to:
- collect data from children
- collect sensitive personal data (such as health, religion or financial account numbers) through custom questions
- send spam
- run deceptive, illegal or pyramid-style schemes
- break Shopify's rules
5. Our responsibilities
- We'll make reasonable efforts to keep Affiliate King available, secure and working as described.
- We'll provide support by email at contact@dubientdesigns.com.
- We'll handle the personal data in your programme as described in Part B and in our Privacy Policy.
6. Accuracy and attribution
Affiliate King credits sales using referral links, discount codes and your rules. Attribution can't be perfect. For example:
- a shopper may clear their cookies or switch devices
- a shopper may decline cookies
- a shopper may use another creator's code
You must check commission before paying it. We aren't liable for commission paid or not paid because of how a sale was attributed.
7. Your content and data
- Your content and data stay yours. This includes your settings, sign-up page content, images, creators' data and order data.
- The rights you give us: you give us the rights we need to host it, process it and show it, solely to provide Affiliate King.
- Uninstalling: when you uninstall, we delete your store's data 48 hours later, as described in Part B. Export anything you need first, for example with the CSV exports.
8. Our intellectual property
Affiliate King, including its software, templates, artwork and branding, belongs to us. You may use it only through the app, while you use the app. On the Free plan, the sign-up page shows "Powered by Affiliate King".
9. Changes to Affiliate King and these terms
- Changing the app: we may change, add or remove features. If we remove a paid feature you rely on, we'll give you reasonable notice.
- Changing these terms: we may update these terms. For significant changes, we'll tell you in the app or by email at least 30 days in advance.
- Accepting changes: continuing to use Affiliate King after the change takes effect means you accept it.
10. Ending
- By you: you can stop at any time by uninstalling Affiliate King.
- By us: we may suspend or end your access if you seriously or repeatedly break these terms, or if the law requires it. Where we reasonably can, we'll tell you first.
- What continues after ending: sections 6, 7, 11, 12 and 13, and Part B for as long as we hold any of your data.
11. Disclaimers
Affiliate King is provided "as is" and "as available". As far as the law allows, we make no other promises, including about fitness for a particular purpose or uninterrupted, error-free operation.
12. Limits on liability
As far as the law allows:
- Indirect losses: we aren't liable for indirect or consequential losses, or for lost profits, revenue, data or goodwill.
- Total cap: our total liability for all claims under these terms is capped at the greater of (a) the amount you paid us in the 12 months before the claim and (b) USD 100.
Nothing in these terms limits liability that can't be limited by law.
13. Disputes and governing law
- Governing law: these terms are governed by the laws of Singapore.
- Courts: the courts of Singapore have exclusive jurisdiction.
- Talk to us first: before starting a claim, please contact us so we can try to resolve it informally.
14. General
- Whole agreement: these terms, together with the Privacy Policy, are the whole agreement between us about Affiliate King.
- Invalid parts: if part of them is unenforceable, the rest still applies.
- Transfers: you may not transfer these terms without our consent. We may transfer them as part of a reorganisation or sale of the business.
Part B: Data Processing Agreement
This Part applies where data protection laws such as the GDPR or UK GDPR apply to the personal data in your creator programme.
B1. Roles
- You are the controller of the personal data of your creators and shoppers ("Programme Data").
- We are your processor. We process Programme Data only to provide Affiliate King, following your documented instructions. Your instructions are these terms and the settings you choose in the app.
- Unlawful instructions: if we think an instruction breaks data protection law, we'll tell you.
B2. What we process
| People | Creators who apply to or join your programme, and shoppers who place orders a creator referred. |
| Creators' data | Name, email, and the optional fields you choose to collect (country, phone number, social handles and links, follower range, content type, motivation, answers to your questions). Also consent choices, referral and discount codes, earnings, payouts, payout details (encrypted), and a salted password hash. |
| Shoppers' data | Order numbers, amounts and products, and a one-way hash of the Shopify customer ID. For referral link clicks: a random visitor ID, the landing and referring pages, and a hashed user agent. |
| Purpose | Running your programme: applications, accounts, attribution, commission, payouts and related emails. |
| Duration | While you use Affiliate King, then as in B7. |
B3. Confidentiality and security
Everyone we authorise to process Programme Data is bound by confidentiality. We keep appropriate technical and organisational measures in place, including:
- encryption in transit and at rest
- extra encryption of access tokens and payout details
- salted password hashing
- limited access to production systems
- automatic deletion under the retention periods in our Privacy Policy
B4. Sub-processors
You authorise us to use the sub-processors listed in our Privacy Policy: Shopify, Cloudflare, Resend and bunny.net.
- We'll give you at least 30 days' notice of any new sub-processor, in the app or by email. If you object on reasonable data protection grounds, you can stop using Affiliate King before the change takes effect.
- We impose data protection terms on each sub-processor that are at least as protective as this Part.
Services you connect yourself, such as Klaviyo, aren't our sub-processors. You choose them, and your own agreement with them applies. By connecting one, you instruct us to send it the Programme Data that the integration describes in the app.
B5. International transfers
Where Programme Data leaves the UK or the European Economic Area, we rely on appropriate safeguards. These include the European Commission's Standard Contractual Clauses (and the UK Addendum), as offered by our sub-processors.
B6. Helping you
Taking into account what we process and the information available to us, we'll help you:
- respond to people exercising their data protection rights
- meet your obligations on security, breach notification, data protection impact assessments and consultations with regulators
The app's tools let you view and remove creators, and Shopify's privacy webhooks remove shopper data automatically.
B7. Deletion
When you uninstall Affiliate King, we delete all Programme Data 48 hours later, in response to Shopify's deletion request. We also apply the retention periods in our Privacy Policy while you use the app.
B8. Personal data breaches
If we become aware of a personal data breach affecting Programme Data:
- we'll notify you without undue delay, and in any case within 72 hours
- we'll give you the information you reasonably need to meet your own obligations
B9. Audits
We'll make available the information reasonably needed to show that we comply with this Part. We'll also allow and contribute to reasonable audits, no more than once a year, with reasonable notice, at your cost, and subject to confidentiality.
